Changes to Employment Law due in April 2020

Are you ready for the changes coming up in Employment Law in April 2020?

Under the Good work plan published by the Government in 2018, the following changes are coming into effect on the 6th April 2020.

Statement of Particulars

Currently, employees who have been continuously employed for more than one month must be provided with a written statement of terms within two months of employment.

From the 6th April 2020, every new employee and worker will have the right to a current statement of particulars from day one of their contract.

Additional information will have to be included as part of this extended right.  These include:

  • Hours of work, should provide details of the normal working hours, the days of the week the worker is required to work and whether working hours/days may be variable.
  • Any entitlement to paid leave
  • Any other remuneration or benefits (ie health insurance, childcare vouchers, etc)
  • Details of any probation period (including its conditions and duration)
  • Any training provided by the employer, any training that the employee is required to complete and any mandatory training costs not covered by the employer.

Furthermore, existing employees can, on or after 6th April 2020, request an updated statement of particulars from their employer. This must be delivered to the employee no later than one month after the request has been made.

Holiday pay

The holiday pay reference period adjustment will increase from 12 weeks to 52 weeks.

Employers will now be required to look back at the previous 52 weeks where a worker has worked and received pay, discarding any weeks not worked or where no pay was received, to calculate the average weekly pay.

Statutory Parental Bereavement leave and pay

Bereaved parents will have the right to two weeks of leave following the loss of child under the age of 18, or a stillbirth after 24 weeks of pregnancy.
